Purpose
This policy explains when and how Velaris Management Group LLC (“Xive”) may suspend (temporarily restrict) or terminate (end) your account or access to the Services, what typically happens to your content, data, and monetization, and how you can challenge a decision. It reads together with the Terms of Service, Community Standards, Enforcement Policy, Appeals Process, Moderation Model, Privacy Policy, Data Retention Policy, User Rights (Global Summary), Streaming Compliance—where live features apply—and—where you earn money—Monetization & Payouts.
- Suspension and termination are account-level outcomes. Removal of individual posts, streams, or messages without disabling your whole profile is covered primarily in the Enforcement Policy.
- We may notify you in-product or by email when contact details are valid; lack of receipt does not invalidate a lawful action we have documented internally.
- Nothing here limits remedies we may pursue under contract or law (for example injunctive relief for serious abuse or intellectual-property theft).
Temporary suspension
A suspension limits some or all use of the Services for a period while we investigate, mitigate risk, or apply a proportionate sanction. It is not always a final judgment that you broke every alleged rule.
- Common limits include pausing sign-in, posting, live streaming, messaging, discovery placement, monetization, or payouts while we review suspected policy breaches, fraud, account takeover, payment risk, or legal process.
- We may extend a suspension if new evidence appears, if you tamper with logs or harass reviewers, or if partners (such as payment networks) require continued holds.
- Suspensions should be no broader and no longer than reasonably necessary to prevent harm; duration depends on severity, repeat history, and technical constraints.
Security-driven restrictions
Not every lock on an account is a “strike” for bad behavior. We may restrict sign-in or sensitive actions when we believe the account is compromised, is sending malware or phishing, or is being used as a botnet control point—even if the human owner is also a victim.
- Typical responses include forced sign-out, mandatory password or device review, step-up verification, or temporary read-only mode until you complete a safe recovery flow.
- If you regain control, we usually restore access after risk clears; if attackers repeatedly re-compromise the same account, we may require stronger controls or longer cooling periods.
- Policy-based suspensions and security holds can stack; resolving one does not automatically resolve the other.
Permanent termination
Termination ends the account relationship and usually revokes access. It may follow repeated or egregious violations, legal demands we must obey, prolonged inactivity where the Terms allow closure, business wind-down of a product in your region, or unacceptable risk to users or platform integrity.
- Certain categories—such as child safety, sexual exploitation, terrorism glorification, or extreme illegal activity—may result in immediate termination with no prior warning where law or partner rules require that posture.
- Commercial, partner, or enterprise profiles may face stricter thresholds, audit clauses, or immediate termination rights described in separate order forms or creator agreements.
- We may refuse to reopen service for people who have been permanently terminated except where the Appeals Process or law requires reconsideration.
Legal process, regulators, and investigations
Courts, regulators, and law-enforcement agencies sometimes require us to preserve data, freeze accounts, or stop deletion until an inquiry ends. Those obligations can override your preference to close an account immediately or to erase everything on demand.
- We comply with lawful, properly scoped requests consistent with our Privacy Policy and applicable law; we push back on overbroad or invalid demands where counsel advises we can.
- You may still exercise privacy rights described in User Rights (Global Summary), but responses may be delayed or limited while a legal hold or active litigation exception applies.
- Closing an account does not erase records we must keep for tax, anti-fraud, or sanctions-compliance programs described in Data Retention.
Effect on content, data, and money
Outcomes vary by feature and jurisdiction. The Terms and Content Ownership & Licensing describe your license to us and what survives closure; Privacy and Data Retention describe how long we keep backups, logs, and legal holds.
- Public content may be removed, delisted, or left unavailable even if residual copies persist briefly in caches, CDN edges, or backups.
- Thumbnails, embeds, or search snippets off-platform may linger until third parties refresh; we do not control every mirror.
- Monetization balances, chargeback exposure, and payout timing are governed by Monetization & Payouts; termination does not erase lawful obligations to return fraud proceeds or satisfy tax reporting.
- Messages or collaborative spaces you moderated may be reassigned, archived, or deleted according to product design and safety needs.
- Where the product offers export or download tools, use them before voluntary closure if you need copies; after termination we may not be able to reconstruct personalized views. Privacy and data-access requests are handled under User Rights and may take time during disputes.
Minors, guardians, and delegated access
Where local law or product design gives parents, schools, or workspace administrators oversight of an account, their actions or requirements may interact with suspension and termination decisions we take for safety or policy reasons.
- We may restrict or close accounts that cannot satisfy verified age or parental-consent rules for the features they attempt to use.
- If a guardian or admin requests closure of a dependent or member account, we verify authority according to in-product flows and law before acting.
Usernames, impersonation, and reinstatement
After termination or long inactivity, display names, usernames, URLs, or numeric identifiers may be released for reuse on a schedule that reduces confusion and impersonation risk. We do not guarantee that you can reclaim the same handle later.
- Reinstatement of a terminated account is rare and usually requires a successful appeal or a documented error on our side.
- Good-faith new accounts after an old one was closed for inactivity are not the same as ban evasion; we distinguish intent using behavioral and identity signals.
Third parties, subscriptions, and commerce
Your closure or termination can affect other people who paid for subscriptions, tickets, digital goods, or campaigns tied to your profile. Refund, chargeback, and fulfillment rules live in the Terms, checkout disclosures, and partner agreements—not in this policy alone.
- We may complete, void, or transfer pending obligations according to law and the commercial terms shown at purchase.
- Nothing here promises that every buyer receives a refund when a creator is terminated for cause.
Alternate accounts and circumvention
Creating or using additional accounts, devices, or identities to evade a suspension or termination, to harass people you were separated from, or to continue prohibited conduct undermines trust and may trigger broader enforcement.
- We may link accounts through technical and behavioral signals and take action on all related profiles when circumvention is confirmed.
- Third parties who knowingly facilitate ban evasion (for example selling “aged” accounts marketed for that purpose) may also lose access.
Voluntary closure
You may close your account through in-product flows where we offer them. Voluntary closure is not the same as a punitive termination but can still be subject to final fraud windows, payout minimums, and retention rules described elsewhere.
- Settle or download anything you need from wallets, drafts, or creator tools before you confirm closure.
- If a dispute or chargeback is open, we may delay final deletion until numbers reconcile.
- You can still submit privacy requests after closure where law allows; responses follow User Rights and Identity verification rules.
Appeals
If you believe a suspension or permanent termination was mistaken, disproportionate, or procedurally unfair, use the Appeals Process linked from your enforcement notice or help center. Include identifiers, dates, and any new information we did not have at decision time.
- Appeals generally do not stop lawful preservation or production of records required by valid legal process.
- If an appeal overturns a termination, we restore access when technically and contractually feasible; some content or handles may be unrecoverable.
